At the Civil Procedure Rules Committee meeting the question was asked of the Hutton Committee (the committee which LJ Jackson tasked with devising a new bill of costs):
What about Court of Protection, solicitor/client disputes, Arbitration Act and Tribunals – does the new bill format apply?
The Hutton Committee responded as follows:
“There is no proposal to introduce the new BoC other than in the categories of litigation that may be made subject to CMOs. It may be that use of the BoC in other areas would be encouraged by a voluntary practice direction and that its use as a standard format may be extended to other categories of work in the future…”
At the moment it has been intimated that the new bill of costs will not apply to Court of Protection work, however things may change – watch this space…………
